A Lugbe Grade 1 Area Court on Thursday sentenced a 20-year old mechanic, Jamilu Ahamodu, to three-month imprisonment for stealing a mobile phone worth N11, 500.
The Judge, Mr Garba Ogbede, said that the court had no option than to sentence the convict accordingly since he had pleaded guilty to the charge.
Ogbede, however, gave the convict an option of N15, 000 fine and also ordered him to pay the complainant, N11, 500 restitution.
Garba said that the punishment would have been more severe if the convict had not pleaded guilty.
He said that convict’s plea saved the court the pains of prolonged prosecution.
The judge warned the convict to be of good behaviour and to desist from committing crimes after serving out his punishment.
The News Agency of Nigeria (NAN) reports that Ahamodu, who resides in Lugbe Zone 2, Abuja, was charged under Section 288 of the Penal Code for stealing.
Earlier, the Prosecuting Counsel, Mrs Aderonke Imana, had told the court that on April 4 one Muhammed Isah of Lugbe Zone 2, reported the case at Lugbe Police Station.
Imana said that the convict broke into the complainant’s room at about 9.30 p.m. and stole his Tecno phone.
She said that the complainant raised an alarm when he came back to his house and discovered that his room was burgled.
Imana said that the complainant rushed to the station and reported the incident for proper investigation which led to the arrest of the convict.
The prosecuting counsel said that the convict admitted committing the offence during police investigation and interrogation.
Following the plea of the convict, the prosecutor prayed the court to try him summarily under Section 347 of the Administration of Criminal Justices Act, 2015. (NAN)
